TESYS ACTIVOS FINANCIEROS SGIIC S.L. processes the information provided by interested parties in order to be included in a file for the management of the customer service department (intended to handle and resolve complaints and claims submitted by clients, in accordance with Order ECO 734/2004 of March 11, on the customer service departments and services and the customer ombudsman of financial institutions, published in BOE No. 72 of March 24, 2004), which could not be carried out without personal data.

For what purpose do we process your personal data?
TESYS ACTIVOS FINANCIEROS SGIIC S.L. processes the information provided by employees to be included in a file for the planning and management of human resources. This includes processing related to hiring, payroll preparation and bank payments, working hours and vacation control, the processing by an external labor advisor of social security, mutual insurance, and occupational risk prevention, as well as the regulation of any employment activity linked to the employee, which could not be carried out without personal data.
TESYS ACTIVOS FINANCIEROS SGIIC S.L. ensures the processing of personal data in compliance with current data protection legislation, applying the necessary technical and organizational measures to ensure security in the processing of data.
How long will we keep your data?
Labor-related personal data will be kept for the duration of the employment relationship and for six years after the employee ceases to provide services to our entity (taking into account Organic Law 7/2012, of December 27), for the purpose of making them available to public administrations with labor competence in processes of requirements and inspections. Promotional images and audio will be kept until the data subject requests their deletion.
With respect to the authorizations collected under “Basic Information on Data Protection,” data will be kept until consent is revoked.

TESYS ACTIVOS FINANCIEROS SGIIC S.L. processes the information provided by whistleblowers in order to manage, process, and investigate possible reports, through the Internal Information System (SII), in accordance with Law 2/2023 of February 20, regulating the protection of persons who report regulatory breaches and fight against corruption. Such processing could not be carried out without personal data.
TESYS ACTIVOS FINANCIEROS SGIIC S.L. ensures the processing of personal data in compliance with current legislation, applying appropriate technical and organizational measures to safeguard the security of personal data.
How long will we keep your data?
Data processed may be stored in the information system only for the time necessary to decide whether to initiate an investigation into the reported facts.
If it is proven that the information provided, in whole or in part, is not true, it will be deleted immediately upon confirmation of such circumstance, unless the falsehood could constitute a criminal offense, in which case the information will be retained for the necessary time while judicial proceedings are ongoing.
In any case, if three months have passed since receipt of the communication without any investigation being initiated, the data must be deleted, unless the purpose of retention is to provide evidence of the system’s operation. Communications that are not pursued may only be recorded in anonymized form, without application of the blocking obligation.

Article 6.1(c) GDPR: Processing is lawful where it is necessary for compliance with a legal obligation to which the controller is subject, in accordance with Article 30 of Law 2/2023 of February 20, regulating the protection of persons who report regulatory breaches and the fight against corruption (in cases of mandatory internal communication channels).
Article 6.1(e) GDPR: Processing is lawful where it is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller, in accordance with Article 30 of Law 2/2023 (in cases of non-mandatory internal channels, external reporting channels, or public disclosures).
If special categories of data are processed, the legal basis will also be public interest, in accordance with Article 9.2(g) GDPR.
Will your data be shared with third parties?
The data you have provided are addressed to TESYS ACTIVOS FINANCIEROS SGIIC S.L. (principally the System Manager, the Data Protection Officer, the Head of Legal Services if legal action is necessary regarding the reported facts, the Head of Human Resources or the competent body duly designated, only if disciplinary measures against an employee may apply), as well as to Public Administrations with competence in the matter and Judicial Authorities.
TESYS ACTIVOS FINANCIEROS SGIIC S.L. may also collaborate with specialized compliance services, which means that necessary data may at some point be transmitted to the IT systems of third-party providers with whom the data controller has signed confidentiality agreements.
